Specific commitments signed by each Weclimb Coach on registration

This contract is published in clear text for transparency. It will be signed electronically by each Coach at the time of registration, from the opening of Coach registrations on weclimb.gg.

Between the undersigned

Lowdout, a SASU with share capital of €500, registered in the Paris Trade and Companies Register under number 994 685 550, with its registered office at 60 rue François 1er, 75008 Paris, represented by its Chairman, Mr Eliott Le Duc, hereinafter referred to as "Lowdout" or "the Platform",

and the Coach, whose identity is made known to Lowdout as part of the registration process, hereinafter referred to as "the Coach",

it is agreed as follows.

Preamble

Lowdout operates the Weclimb platform, accessible at weclimb.gg, dedicated to putting competitive video game players in touch with independent coaches. The purpose of this contract is to formalise the Coach's specific commitments in terms of fair play, non-use of undeclared artificial intelligence and non-disintermediation. The Coach acknowledges having read Lowdout's General Terms and Conditions of Use and General Terms and Conditions of Sale, and also accepts the additional undertakings set out below.

Article 1: Commitment to authentic coaching

Throughout their registration on the Platform, Coaches undertake not to:

  • to provide a boosting, duo-boosting or smurfing service for the benefit of a Player;
  • logging into a Player's Riot Games account for any reason;
  • to offer a Player seeking its help services consisting of raising the Player's rank without transmitting knowledge.

Article 2: Integrity of the account

The Coach undertakes to report to Lowdout, within forty-eight (48) hours of their occurrence, any attempt by a Player to communicate Riot Games identifiers, as well as any duo-boost proposal received via or in connection with the Platform.

Article 3: Commitment to fight undeclared generative artificial intelligence

Given the educational and personalised nature of the coaching service, the Coach undertakes :

  • to personally produce, in a substantial manner, the content of each analysis, review, feedback or comment that he delivers to a Player;
  • not to use, without prior express declaration to Lowdout, a generative artificial intelligence system, whether it be a language model, a conversational assistant, a text generation tool or any other similar device, to produce all or part of the content delivered to a Player;
  • to authorise Lowdout to subject the Coach's production to tools for detecting content generated by artificial intelligence, and to cooperate in good faith with any verification procedure, as part of the Platform's anti-fraud system;
  • to use, when requested, the Lowdout Companion application or any other tool made available by Lowdout to produce traces of active presence (annotations on the VOD, time spent on the service, user interactions).

The Coach acknowledges that generative artificial intelligence, when used as an internal assistant to the Coach (for example to facilitate the drafting of an outline, to structure a feedback, or to suggest angles of analysis), is not in itself prohibited by the present article, as long as the final content delivered to the Player results from a substantial and personalised human analysis. In all cases, the Coach remains responsible for the content he delivers.

Article 4: Graduated penalties

If the Coach breaches any of the above commitments, Lowdout will apply a scale of sanctions depending on the seriousness and repetition of the breach:

  1. Written warning sent to the Coach by electronic means, indicating the breach observed and inviting the Coach to submit his observations within seven (7) days;
  2. Temporary suspension of the Coach account for a period of between seven (7) and ninety (90) days, in the event of serious misconduct following a warning or in the event of an initially serious misconduct;
  3. Definitive termination of this contract and closure of the Coach account, without compensation, in the event of a particularly serious breach, in the event of a repeat offence, or in the event of proven fraud;
  4. Retention of unpaid sums. Where fraud has vitiated the purpose of a service already paid by the Player but not yet paid to the Coach, Lowdout is entitled to withhold these sums and refund them to the Player concerned;
  5. Reporting of boosting, account sharing or outright fraud to Riot Games Inc. in accordance with the commitments made by Lowdout as part of its partnership with Riot Games.

Before applying any sanction other than a written warning, Lowdout will send the Coach a reasoned notice and give him or her seven (7) days to present his or her observations, except in the event of serious and blatant fraud that puts one or more Players or the Platform itself in immediate danger.

Article 5: Applicable law and jurisdiction

This contract is governed by French law. In the absence of an amicable agreement, any dispute arising from its interpretation or performance will be referred to the competent courts within the jurisdiction of the Paris Court of Appeal.
